These terms govern your access to and use of Tendie Terminal. By creating an account or using the platform you agree to them. Read section 01 in particular: it is the one that decides who carries the risk on a trade.
01 / No investment advice
Tendie Terminal is an informational, mathematical, and algorithmic market data platform. Scanners, options flow, regime models, backtests, indicators, and every other output are analytical tools. They are not financial, legal, tax, or investment advice, and nothing on the platform is a recommendation, solicitation, or offer to buy or sell any security, derivative, or other instrument.
We are not a broker-dealer, investment adviser, or fiduciary, and no communication from us creates an advisory relationship. Any signal, ranking, score, or alert is a description of data, not a directive to act on it.
You are solely responsible for your own trading decisions and for every order you place. Trading equities and options involves substantial risk, including total loss of principal; options can expire worthless and certain strategies carry losses exceeding the initial outlay. Past performance and backtested results do not indicate future results. Consult a licensed professional before acting on anything you see here.
02 / Warranties
The Service, including all market data, options flow, quantitative models (HMM regime states, indicators, scanner rankings, and derived analytics), is provided "as-is" and "as-available" without warranties of any kind, express or implied. We expressly disclaim the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We make no guarantee of timeliness, accuracy, completeness, sequencing, or continuous availability. Data reaches us from third-party providers and exchanges and may be delayed, revised, incomplete, or wrong; models are approximations calibrated on historical data and may be miscalibrated in any given market. We do not warrant that the Service will be uninterrupted, error-free, or that any defect will be corrected.
No warranty of profitability is made or implied. To the maximum extent permitted by law, we are not liable for any trading loss, lost profit, or indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Service. Where liability cannot be excluded, it is limited to the fees you paid us in the twelve months preceding the claim.
03 / Acceptable use
Your account is personal and non-transferable. Access is licensed to you as a single user for your own use, and that licence is revocable, non-exclusive, and non-sublicensable.

04 / Billing
Paid plans are billed in advance on a recurring basis and renew automatically for successive periods at the then-current rate until you cancel. Cancellation takes effect at the end of the current billing period; access continues until then, and periods already started are not prorated.
Payments are handled by our payment processor acting as merchant of record. That processor is the seller of record for your transaction, and its terms govern payment collection, tax handling, chargebacks, and refunds. Refund requests are resolved under the merchant of record's refund policy.
We may change pricing with notice before your next renewal. Continuing the subscription past that date is acceptance of the new rate. Fees are exclusive of taxes except where the merchant of record collects them.
05 / General
We may modify or discontinue features at any time, and may suspend or terminate an account that breaches these terms or presents a security or legal risk. You may stop using the Service at any time.
We may update these terms; material changes are reflected in the effective date above, and continued use after that date is acceptance. The disclaimers, limitations of liability, and acceptable-use restrictions survive termination.
If any provision is held unenforceable, the rest remains in effect.
